Terms and Conditions

1. Scope of Application

These Terms and Conditions apply to all services offered on this website, particularly the ordering of 3D visualizations.

2. Use of Uploaded Files

By submitting files (e.g., photos, CAD models), the client grants us permission to use them for the creation of 3D visualizations. If the materials are insufficient, we reserve the right to request additional information. Processing will be paused until all required materials are received.
If the client fails to provide sufficient materials within four (4) weeks of our request, the project will be canceled. In such cases, 20% of the total fee will be retained, and 80% will be refunded to the client.

3. Delivery Times

We aim to deliver 3D visualizations within four (4) business days after receiving all required input files. This applies to standard renders (e.g., furniture). More complex products or special requests may require additional time.
Delays caused by missing or incomplete client data will result in adjusted delivery timelines. Clients may not claim compensation if the 4-day window is exceeded. However, Best Renders 24 may, at its sole discretion, offer a goodwill adjustment.

4. Rights to Visualizations and 3D Models

Clients retain ownership of the 3D visualizations they purchase. Best Renders 24 reserves the right to use completed visualizations for promotional purposes unless the client explicitly opts out.
If the client provides an existing 3D model (e.g., FBX, OBJ), ownership remains with the client.
If we create a 3D model from sketches, photos, or non-3D files, the resulting CAD model remains our intellectual property. Clients may purchase these models separately for an additional fee, depending on model complexity.

5. Intellectual Property & Confidentiality

All intellectual property provided by the client remains their property. For prototype development, confidentiality will be maintained if explicitly requested. An NDA (Non-Disclosure Agreement) can be arranged upon request.

6. Payment Terms

Payment is due in advance. Refunds are only available if the project is canceled before work begins. If canceled after work has started, a partial fee will be retained based on the amount of work completed.

7. Disclaimer of Liability

Best Renders 24 is not liable for delays or issues arising from incomplete or incorrect client-provided information. We are not responsible for delays due to unforeseen technical problems or force majeure.
For damages caused by ordinary negligence, we are only liable for breaches of essential obligations (“cardinal duties”), and only up to the foreseeable amount typical for such contracts.
Further liability exists only in cases of proven gross negligence or willful misconduct.

8. Revisions, Complaints & Warranty

Complaints must be submitted in writing or via our website dashboard under “Revisions” within seven (7) days of delivery.
Each project includes one (1) free revision. Additional revisions may incur a fee based on effort.
If a complaint is valid, we will make appropriate corrections. No liability is accepted for dashboard outages or temporary technical limitations. Best Renders 24 does not guarantee uninterrupted or error-free service.

9. Data Protection and Privacy

All uploaded files and personal data are treated confidentially and used solely to fulfill the agreed services.

10. Data Loss Disclaimer

Best Renders 24 is not liable for data loss due to technical failure, unforeseen events, or force majeure.
Clients are advised to retain backups of all files before uploading them to our platform.

11. Data Security Measures

We use appropriate technical and organizational measures to protect your data during transmission and storage. However, no internet transmission is entirely secure. Clients are encouraged to take extra precautions when transmitting sensitive information.

12. Limitations of the Online Order Form

Our online form is currently optimized for furniture renderings. For requests involving architecture, packaging, buildings, or general prototypes, please contact us directly.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the State of Florida, United States.
The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is St. Petersburg, Florida, unless otherwise required by law.

14. Amendments

We reserve the right to update or modify these Terms at any time. The current version is always available on our website. Changes become effective immediately upon posting.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
